FACTS: The New York Times has obtained the notes and comments from certain individuals in the Department of Defense (Pentagon) related to the how the war in Vietnam was being conducted. The Times wishes to publish these notes and comments. Before the publication commences, the United States files suit to enjoin the Times from printing the information based on the premise that "national security" is being compromised. No illegal transfer of information has taken place by anybody.
