Problem: The 4thAmendment provides for people to be secure in their persons, houses, papers and effects yet police officers frequently find the need to conduct warrantless searches for reasons of detecting crime, self-protection, protection of the public, etc. The Exclusionary Rule was designed to punish government officials for having taken actions that are not consistent with our Constitutional rights. Explain what the Exclusionary rule is, how it works, and provide whether you feel it is doing enough to prevent officials from over stepping their authority. If you feel it is lacking, then what would you propose in its place? Lastly, would you be willing to waive your 4thAmendments rights in the interest of making our society safer by allowing law enforcement to conduct searches on less than probable cause? Explain fully why you would or would not?
