Problem
In Francisco Foods, Inc. , 2000 NLRB LEXIS 200, *42 (N.L.R.B. March 31, 2000), an Administrative Law Judge ("ALJ") for National Labor Relations Board found that Francisco Foods violated Sections 8(a)(1) and (5) of the NLRA when it refused to recognize and bargain with the Union when requested to do so. In two-hundred and fifty (250) words, or less, make an argument as to why the ALJ's decision was legally erroneous.
