I disagree with the court that prisoners do not have the right to DNA testing.
Why not allow Death Row convicts to get DNA testing on available biological evidence in their cases rather than risk murdering an innocent person? Why not make testing available to those who have been convicted of major non-capital crimes? It's easier and less expensive to test than it is to hold a court hearing to stop it. Furthermore, testing is not a "get out of jail free card"-DNA can confirm guilt and may not go far enough to prove innocence.
DNA Evidence Accuracy
DNA evidence is extremely accurate if investigators properly gather and handle biological evidence and forensic scientists use approved methodologies and conduct the analysis correctly. The chances of one person's DNA profile matching another's are exceedingly slim - one in a billion, according to some estimates (but there is quite a bit of debate about this). DNA evidence is a highly successful means to match a suspect to biological samples acquired during a criminal investigation, as opposed to fingerprinting or eyewitness testimony, which both have defects and errors.
Criminal lawyers increasingly rely on this form of evidence to show a defendant's guilt or innocence due to its precision. Through post-conviction study of biological samples, this form of evidence has also exonerated persons. Because DNA analysis was not available until recently, reexamining evidence from previous investigations can indicate that the DNA profile of the person convicted of the crime differs from the DNA profile of biological samples gathered at crime scenes.
Testing the inmates should be at their cost or the cost of their families just as they covered for their legal fees when hiring attorneys. If the courts have the time and the manpower tom listen to court cases and subsequent court appeals, how can't they find time to reconfirm their decisions? The issue of time is just an accuse that leads to denial of justice.
