Jane feels that she is being discriminated against when her best friend, Jack, gets promoted at work. Jane has the same credentials as Jack, plus she has worked at the company much longer than he has. In order to prove that, indeed, sex discrimination is occurring in the company, Jane'sattorney requests the promotion records from the HR department. Her attorney finds that in thelast 10 years, 5 out 25 women in the department have been promoted and 10 out 50 men havebeen promoted. Does Jane have a case for sex discrimination? Why?
Case 2.
Dan, who is African American, believes that new management at his friend's company shows favoritism toward young white job applicants. Dan graduated second in his MIT class and is top-notch engineer. He was recently rejected for a position at his friend's company. His friend, who was hired, never took school very seriously and barely passed several of his classes. Dan retains an attorney who reviews the selection ratios from the company in the last five years. Itappears as though, the company has hired only five Caucasian candidates out of 20 applicants,and one African American candidate out of 10 applicants. Does Dan have a case against the company?
