Assignment Task: The parties have agreed that two issues will be argued before the Arbitrator:
1. Whether there was just cause for discipline in all of the circumstances; and
2. If there was cause for discipline, whether the penalty of discharge was appropriate in the circumstances.
The parties have agreed that there is no evidence that Ken was addicted to gambling at the relevant time, although at the termination meeting the employer was advised that the grievor had experienced "gambling problem". The only active discipline on Ken's record is the verbal warning given to him in July 2021.
