Problem
McKenna is an engineer who began working for the hybrid vehicle division of an automobile manufacturer. The specifications and schematics for the hybrid vehicle program were maintained as trade secrets. McKenna signed a non-disclosure agreement, but he did not sign a non-compete agreement. Recently, McKenna was contacted by a competing automobile manufacturer and offered a comparable position with double his current salary. McKenna quit his job and accepted the new position. His former employer wants to prevent him from taking the new position, but it does not have any proof (yet) that McKenna has violated his non-disclosure agreement. What legal basis, if any, might McKenna's former employer have to prevent McKenna from taking the new job with its competitor? Make sure to explain your answer.
