Problem:
What is it that society is trying to accomplish in sentencing? Review the goals of sentencing (deterrence, incapacitation, rehabilitation, etc.), but what is it people really want? Does one goal outrank the others?
In addition to sharing your informed opinion on these questions, conduct research to inform yourself on the arguments that sentencing principles have a greater negative impact on marginalized communities. Is there an undue negative impact? If so, is there a manner in which it may be eliminated or minimalized?
