Workers' compensation is a creature of statute. And, statutes vary by jurisdiction. Generally, workers' compensation is an exclusive remedy for employees injured on the job. The employee submits a workers' compensation claim, and the matter proceeds in court without a jury. Sometimes there is an arbitration hearing. Many times, these cases settle. When an employer has workers' compensation insurance, as they are required to have, the employee must submit a claim to the insurer, and cannot proceed in a lawsuit against his employer. If the employer does not have workers compensation insurance, then the employee is able to sue his employer directly.
