Problem: The U.S. Constitution appears to put a considerable amount of power over foreign policy in the hands of Congress and yet since the end of the second world war Presidents have exercised power over the foreign policy of the U.S. with few constraints. What explains this rise in Presidential power? What constraints does the President continue to face from Congress and the Judiciary?
