Assignment:
Use the Supreme Court case, Maryland v. King, to answer the following questions.
1. What are the facts of the case? Briefly describe what happened to cause King to arrive before the Supreme Court.
2. What amendment is being discussed? What is the legal question before the court?
3. Justice Kennedy wrote the opinion of the court; briefly describe what he concludes about DNA collection and the 4th Amendment.
4. What are the four "categories" Justice Kennedy identifies that supports the "State's interest".
5. Justice Scalia wrote the dissenting opinion; why does he believe the other 5 justices "got it wrong"?
6. What does Justice Scalia "fear"?
7. Who is "correct" in their opinion? Justice Kennedy or Justice Scalia? State why you "picked the side" you did WITHOUT referencing King.
8. How can the Constitution limit government actions when the Supreme Court can decided that certain parts of the Constitution no longer apply? Is this concerning or is this necessary to ensure the Constitution "keeps up with the times"?
