Problem
Nick, a college student, and Marcela, a high school music teacher, were both in the cast of In the Heights (a musical) at a local community theatre. After the opening night performance, Nick greeted a few of his friends that were in attendance at the show in the lobby of the theatre and told them that Marcela intentionally tripped one of the other cast members in the show while on stage. The cast member she allegedly tripped is a student at the high school Marcela works at.
• Under what theory of tort law may Marcela bring a suit against Nick? Can she prevail?
• What could be Nick's most important defense?
