Stacy has been arrested and charged with simple possession and possession with intent to distribute. Stacy is homeless and has no ties to the community. She was a run-away teen who ended up in this city and has been working the drug and prostitution trade for the last three years. Stacy has no real income. The money she makes from prostitution goes to support her drug habit. She has a long arrest record, but it is all for misdemeanor drug and prostitution charges.
Do you believe that Stacy should be given bail or be required to stay in prison pending her trial? Considering what you have learned about the bail process, what are two reasons to support your position? Should the income of the arrestee be a factor in deciding whether or not bail is appropriate? What alternative to prison might you suggest for Stacy at this point?
