a) Peter owned two adjacent shops which fronted directly unto a busy street. In one shop, he sold Arts and Crafts and in the other he ran a Café. On the outside wall of the Café, he affixed a notice advertising the Art and Crafts shop. Behind both shops was a yard belonging to Peter which backed unto the road. Deliveries for the shops were usually made to the yard and Peter parked his car there.
In 1991, wishing to concentrate on the Art business, Peter leased the Café to James for 10 years. Initially, Peter did not object to the use of the yard for deliveries to the café or parking his van there but in 1994, differences arose between the two and he told James to stop using the yard. James retaliated by removing the advertising notice from the Café's wall.
Was an easement created for the use of the back yard for deliveries and parking and was one created for the use of the cafe's wall to advertise the arts business?
