You are a United States District Judge for the Northern District of Virginia. You have heard the Plaintiff’s testimony against the use of IQ tests to assess minority children for special education placements as well as the defendant’s testimony for continuing such assessment. You have also reviewed all the transcripts from the Larry P. vs. Riles and Pase vs. Hannon decisions and read many books on measurement.

a. How will you decide the extent to which a test is fair for use in making decisions about students? List and explain your action steps.

b. Please state your opinion regarding the continued use of these tests. How does the use of these tests fit into the RTI (Response to Intervention) process?

c. Should the use of CBM (Curriculum Based Measurement) or CBA (Curriculum Based Assessment) take the place of measures of cognitive ability? Explain your answer

d. Your opinion must indicate the assets and limitations of individual tests of intelligence and

e. You must clearly state the basis for your final decision.
