U is desirous to purchase N's car. He wrote to Non Wednesday 26th October 2016, offering to buy his car for $120, 000 and indicated that if he does not get an answer from N by the weekend, he will consider that they have a binding agreement.
N got another offer from Kon Monday 31st October 2016, for a more attractive price and sold the car to K. U is very upset and wants to take legal action against N. He is of the view that they had a binding agreement, because N did not respond to his offer over the weekend and as such he concluded that N accepted his offer thereby creating an agreement. Advise U.
