The United States Constitution created three separate branches of government: the Executive Branch; the Legislative Branch; and the Judicial Branch. The stated role of the Judicial Branch is to interpret the Constitution. In recent years, certain rulings and non-rulings of the Supreme Court have had a profound effect on our society. Some argue that these decisions (or non-decisions) effectively create new laws that have not gone through the process prescribed by the Constitution. Others argue that the Supreme Court is well within its authority to interpret the Constitution and the results are merely the effect of the Supreme Court utilizing its enumerated Constitutional powers.
