The FAA has no evidence of widespread use of drugs among commercial aviation personnel. However, there is evidence that some persons engaged in commercial aviation do use illicit drugs. Consequently, the FAA has established a comprehensive random drug testing policy of airline employees. The tests are to be conducted by the FAA. Airline employees have contested the policy on the grounds that it violates their Constitutional rights under the Fourth Amendment. Will a challenge of this policy on these grounds succeed in court? Why or why not?
