The City of Milwaukee is considering suing the manufacturers of handguns and other firearms, on the basis of a “public nuisance.” “Nuisance” is defined under Wisconsin statutes as “any source of filth or cause of sickness.” The theory is that laxity in the distribution of guns by the manufacturers allows for more gun-related injuries, causing higher expenditures by the city on police and ambulance services. Does such a lawsuit have merit, or is this simply a means to circumvent any challenges to gun control legislation?
