Termination of employment


Scenario 1: Jack has been under continuous employment with World Knitting Factory for 12 years. Last Friday Jack was called to the Director’s Office and verbally informed that his employment was terminated and he was given three weeks remunerations in lieu of notice.

Scenario 2: II. Jack asked the Director to explain why his employment was terminated. The Director said he didn’t sign any written agreement with Jack and therefore there was no contract of employment between the Factory and Jack.

Scenario 3: The Director added he didn’t owe Jack any explanation as to his termination of employment.

Advise Jack on the following issues:

(a) Is there a contract of employment between Jack and World Knitting Factory in present circumstances?

(b) Is there any legal duty upon an employer to state the reason(s) of termination of employment of a worker under the provisions of Employment Rights Act 2008?

(c) Does the 3 weeks payment in lieu of notice for the termination of the employment of Jack with his employer meet the provisions of Employment Rights Act 2008?

(d) Can the action of the Director in the said circumstances be justified if he had merely told Jack that he was dismissed for misconduct? If not, why not?
