Fact Pattern Cc BBQ is a small restaurant owned by Mike. Up until July 31st, 2013 MC faced very little competition. On August 1, 2013, Hooter's (a restaurant known for hiring young, attractive female waitresses) opened a restaurant across the street from MC. MC BBQ saw its business drop 60% by December 1, 2013(particularly amongst its male customers) and MC BBQ decided to make some changes. Mike announced on January 1, 2014 that all male employees who waited on customers had to weight les than 225 pounds by march 1, 2014 or face the possibility of being fired.
Tom weighed 238 pounds on January 1st and, despite Mick's warning, weighed 340 pounds on March 1st. Tom had been an excellent employee, but on march 2nd, MC management fired Tom (age28) for "being more than the target weight of MC BBQ. Tom filed a lawsuit for wrongful termination of his employment contract with MC BBQ. Since MC BBQ implemented its new weight policy for male employees, its business has rebounded and is almost back to where it was when Hooter's opened. MC BBQ appears to be attracting more female customers than ever before.
