Rush signed a covenant not to compete contained in a medical partnership agreement. It prohibited a partner leaving the partnership from engaging in the practice of medical or surgery within a twenty-five-mile radius of the partnership office for a period of three years. Rash, in executing the covenant , expressly agree that the covenant was reasonable and that breach of covenant would work harm to the partnership. Is the agreement enforceable? why? or why not?
