Rape shield laws enacted by the U.S. federal government and by most or all U.S. states contain exceptions wherein evidence of past sexual behavior may be admitted in certain circumstances.
For this weekspaper, review the federal rape shield rule and list the rationales for having any exceptions to the rule in place and the advantages and disadvantages of having those exceptions.
In addition, respond to the following questions:
• Does a persons sexual activity in the past have anything to do with the current charge and the outcome?
• May a persons past sexual activity unjustly prejudice the judge or jurors? Why or why not?
