One of the fundamental rights associated with the healthcare system is the patient's right to informed consent.

This principle is deeply rooted in the ethical framework of healthcare and is supported by various laws and regulations, including Common Rule and state-specific informed consent laws. Essentially, before any medical procedure or treatment is performed, healthcare providers are obliged to inform the patient about the nature of the procedure, potential risks, benefits, and available alternatives. The patient can make an educated decision about their health (Teitelbaum & Wilensky, 2020). For instance, in a case where a patient is diagnosed with a life-threatening condition like cancer, the physician must explain all the treatment options, their potential side effects, and the probable outcomes. Similarly, in clinical trials, participants must be fully informed about the purpose of the study, procedures involved, potential risks, benefits, and their right to withdraw at any point without reprisal.

Patient Right to Privacy

Another critical patient right is the right to privacy, which is primarily protected under the Health Insurance Portability and Accountability Act (HIPAA). This law stipulates that healthcare providers and other entities handling personal health information must ensure the confidentiality and security of such data. It gives patients control over who can access their health information and how it can be used (Xu, 2019). For example, a patient admitted to a hospital has the right to have their medical condition kept confidential. Unless necessary for treatment or required by law, the hospital staff cannot disclose the patient's health information to others without the patient's explicit consent. Another example would be electronic health records (EHRs) systems, which must implement robust security measures to prevent unauthorized access to patient data. Violations of HIPAA result in severe penalties, reinforcing the importance of respecting patient privacy.

These rights maintain trust in the healthcare system and ensure that patients receive care that respects their autonomy and dignity.
