Problem: During the Constitutional negotiations of 1981, Pierre Trudeau's Federal Government gave into provincial demands for the supremacy of their Legislatures over Federal legislation or Supreme Court of Canada decisions to get his Charterof Rights and Freedoms. Until recently, this has not been a big problem. However, Québec's recent legislation further enforcing a secular society and the primacy of French everywhere (Bills 21 and 96), and the proposal in Alberta for a Sovereignty Act overriding federal legislation, suggests a battle royale is coming this decade between the provinces and Ottawa. Research the use of the notwithstanding provisions from 1982 to now, and argue either for keeping this regardless of the consequences, or eliminating it.
