I select a topic should Affirmative Action Laws be changed? The topic that I have selected for my research paper is if the affirmative action laws should be changed. There are two reasons that I have used this topic. Firstly, the topic is of special importance both in academic as well as business and government spheres. Secondly, the law is giving rise to heated debate for its being against the intended purpose in reality and has attracted lots of criticism from different corners. Generally, affirmative action is referred to as the process by which a business agency or a government agency grants special employment and advancement rights to ethnic minorities. The country has had a history of racial discrimination and the affirmative action laws in a way try to compensate for it by giving some minority applicants the extra support through some special provisions. However, frequently a question arises that if the affirmative action laws serve the intended purpose. The affirmative action laws are an attempt at elimination of discrimination as well as at the redressal of past effects of discrimination. But, sometimes affirmative action is also likened to segregation laws. The validity of the affirmative action laws has also been questioned several times. These issues, debates and arguments indicate that in the near future it could be necessary to abolish the affirmative action laws. In my research paper I will mainly shed light on the issues that have been born of affirmative action laws as well as try to establish if in light of these issues, there is a need to change the law. My paper will discuss the reasons for changing the laws as well as shed light on the situations where these laws are giving birth to trouble. In 1964, Lyndon B. Johnson signed the Civil Rights Act of 1964, eliminating preference in education and employment based on race, sex, religion, as well as other phenotypic characteristics that do not adequately evaluate the nature of an individual. Affirmative Action is a set of policies generally used to promote the diversity of a particular race or characteristic. Affirmative action may also be thought of as an ability to help individuals who have faced inadequate treatment in the past. Although affirmative action is a good idea in theory, affirmative action promotes discrimination and violate the Civil Rights Act of 1964 as well as many other important Supreme Court cases. 
A very important Supreme Court case, Bakke. v. University of California Board of Regents (1978), determined the use of quotas in education unconstitutional. In 2003, Gratz v. Bollinger, found that point systems used at the University of Michigan were in violation of the Civil Rights Act of 1964 as well as the Equal Protection Clause (14th Amendment). A twist of events unfolded in 2003 court case, Grutter v. Bollinger, where preference based on race was ruled constitutional in that a diverse student body promotes educational benefits. 
Since the creation of affirmative action and its unregulated use in education, we have seen a birth in unhealthy competition in which groups are looking for preference based on arbitrary characteristics such as race, gender, and religion. Affirmative action favors characteristics that have no bearing on the true success of the individual where contribution to society is unhealthily measured by skin pigment or the religion in which you affiliate. Finally, affirmative action does not provide an adequate process in promoting diversity - instead of moving forward, the use focuses on past injustice instead of looking at equality where people are differentiated based on their skills and passion and not the color of their skin. Affirmative action should promote the idea that humans are all equal, but may be differentiated by their achievements or merits. 
It has been noted by many individuals that Affirmative action is a form of reverse discrimination. One individual, Justice Powell, commented on the court case, Bakke. v. University of California Board of Regents, he added, "Preferring members of any one group for no reason other than race or ethnic origin is discrimination for its own sake." Linda Chavez, president of the Center for Equal Opportunity asserts, "Racial preferences produce a diversity of skin colors but a division of sentiments. They put people of many different races together in a way that makes each racial group see the other racial groups as competitors for some arbitrary advantage." In both of these scenarios we see that affirmative action promotes discrimination by offering a false sense of diversity where people are differentiated based on random characteristics. Racial discrimination can be seen at Howard University where 86% of the students are African American and less than 2% are Caucasian. Affirmative action was originally meant to rectify past abuse to certain groups, the policy is archaic and no longer applies since it is almost impossible to trace the ancestry to past abuse. Even if the ancestry could be traced, the actual beneficiaries are not the individuals who are alive today. 
Another form of abuse caused by affirmative action is the lowering of academic performance among minority students as well as labor market inefficiencies. In one study conducted by Michigan State University, Professors Harry Holzer and David Neumark found a correlation between affirmative action and the likelihood of lower educational attainment. They also found that many minorities fell short of the educational requirements on jobs they were hired into. Another point to make is that many minority students who are given preference at Universities may not perform as well as they could if they were being evaluated solely on academic performance. For instance, if an individual only needs a 3.2 GPA to get into Harvard University, why would the individual strive for a 4.0? Affirmative action in this sense promotes a type of degraded academic performance where evaluation is not based on how you measure academically to your peers. 
In summary it is important to note that affirmative action may seem plausible, but destructive when given a closer look. Affirmative action promotes discrimination in a reverse manner where minorities are promoted based on their race or gender. This form of evaluation decreases competition based on performance and academic merit and also furthers the stigma of racism rather than noting all individuals as equal with differentiation based on achievements and performance. We also see that affirmative action oversteps many boundaries of the Civil Rights act of 1964 and the Equal Protection Clause of the 14 Amendment. 
The solution to the problem is to promote the best possible primary and secondary education for minority students and eliminate the preference based on race, gender, and religion. This will provide a level playing field in which all individuals have an equal opportunity where passion, commitment, performance, and determination are the only factors being considered when finding the qualified individual. This will promote a healthy form of competition fostering academics and achievement while maintaining that all individuals are equal.
