Problem: A manufacturer which includes an actual manufacturer, deemed manufacturer, or unidentified manufacturer may raise defences, if applicable, under s 142 of the Australian Consumer Law. There are a number of these defences available, namely: no safety defect exists at the time of supply; the good complied with a mandatory standard; the safety defect could not be discovered given the state of scientific or technical knowledge. The manufacturer bears the onus of proof of establishing these defences.
