Prohibition:
Section 18 of the Registration of Business Names Act provides that the registration of a company's business name under the Act shall not be construed as authorising the use of a business name if, apart from such registration, the use thereof could be prohibited.
Publication of True Names
Section 23(1) of the Registration of Business Names Act provides that a company using a business name distinct from its corporate name must disclose its corporate name in all trade circulars and business letters on or in which the business name appears and which are issued or sent by the company to any person. Failure to comply with this provision renders the company guilty of an offence punishable by a fine not exceeding one thousand shillings.
