Procedural Technicalities:
In fact here the procedure in the common law courts was highly technical and many good causes of action that were lost due to procedural technicalities. As for example whether A sued B its means that of the tresspass of B's mare and in his writ A described the mare as a stallion so the action would be automatically dismissed there. Conversely this led to the urgent craving for a new system of procedure which would dispense justice without undue regard to technicalities.
