Problem:
As a compliance officer there are many actions that I would take for the organization and information or corrective actions for the employee who had accessed the famous patient's chart. To begin with we all know that in healthcare HIPAA is an extremely big deal. To safeguard medical records, I do believe it would be important to have what I call the breaking glass question for MR that should be considered private. Most famous people most often use the hospital alias for care, so they are not readily identifiable to press etc. Having the broken glass choice for the record, would mean that before the MR can be accessed the person would have to identify who they are before entering the chart, but also why they are entering the chart. This can be a safeguard to the organization, to show that there was in fact a warning for the employees about the chart they were to access before they commit any violations within the organization. If the staff member continues to go into the chart, and we know it had nothing to do with the need to know basis for the patients care, this may result in termination of the employee. The reason I chose termination is because upon hire ALL employees go through training for HIPAA that specifically states the information about not accessing records of patients they are not caring for. Making the choice to do so would mean there was no regard for the policies and procedure set by the organization. After the corrective action had been taken there would be a series of event that would take place, such as notifying the affected party, also notify HHSC and make any changes to any of the safeguards we have in place that may have gaps.
