Q1. Sasha recently signed a one-year lease agreement to rent the basement apartment in Enrico's home, in Scarborough. Her lease runs from August 1, 2023 until July 31, 2024 and the monthly rent is $2,500, due on the first of each month.

a) Sasha just heard that the previous tenant living in Enrico's home was paying $2,000 a month. Has Enrico breached his obligations under the relevant law with respect to the amount of rent he is charging Sasha? Explain your answer.

b) Sasha is hoping to travel to London, England early next year. She is planning to leave February 1st, 2024 and will be returning home on April 30, 2024. Sasha is concerned about paying rent to Enrico while she is away and wants to know whether to assign or sublet her apartment. Explain your answer.

c) Does Sasha have to move out of the apartment on July 31, 2024? Explain your answer.

d) Assume Enrico has decided to make one major renovation on his home. The work is to start March 1, 2024. In order to do the work, Enrico needs access to the entire house. Can Edgar ask Sasha to move out of the apartment at the end of February, 2024? Explain your answer.

e) Sasha has been working from home for the past few years and is thinking of getting a small puppy, whom she wants to name Buddy, for company. Can Enrico evict her because of Buddy? Explain your answer.

Q2. Vilma is buying a resale condominium in Richmond Hill. The sellers are Jose Abruzo and Sandra Jamilla, who own the property as tenants in common.

a) What document will provide information about the amount of Vilma's monthly common expense payments?

b) Against whom must Vilma's lawyer search for executions?

Q3. Wallace bought a new condominium in Brampton and expects to close the deal and receive legal title to his unit sometime in February, 2024. Wallace just learned that his unit is finished and ready for occupancy. Wallace would love to move in to the unit as soon as possible.

a) Can Wallace move in now or must he wait until he receives legal title? Explain your answer.

b) If Wallace moves in before the final closing date, what payment(s) will he be responsible for? Explain your answer.

Q4. Last month, Wei signed an agreement of purchase and sale for a new condominium. The disclosure statement she received indicated that there would be a large party room complete with kitchen and bar facilities. This is very important to Wei because she has a very large family and lots of friends, and loves to host dinner parties. Yesterday, Wei received an amended disclosure statement indicating that there is not going to be a party room after all. Wei is very disappointed. What are Wei's rights (if any) in this situation? Explain your answer.

Q5. Yves purchased a new construction home from Better Builders Corp., a well known builder in Markham, Ontario. Yves lived in the new home for 18 months before selling it to Nathan a month ago. Does Nathan have any warranty protection from Tarion? Explain your answer.
