Assignment task:
Subject: Constitutional Law
Mat who is a drug addict broke into Pak Smail's house in a broad day light and managed to steal RM500 and a Rolex watch. While he was fleeing from the scene, his suspicious act was seen by the villagers who then chased him down. He was caught afterwards. The villagers who were so mad at him because of previous incidents (stealing, sexual harassment), decided to each give him blows on his face and kicked him hard all over his body. He was then brought to the police station.
At the police station, he was investigated for 12 hours straight without being given food or drinks. He was very weak and exhausted but refused to confess to any allegations made against him. He demanded to be given a right to call his family members so that they could engage a lawyer for him. One of the policemen told him 'A thief has no right for a lawyer. In fact, you have no right at all!"
Mat was kept in a lock-up for two days. He was released afterwards. He then went to see you, a lawyer to ask for advice. He wanted to sue the villagers for the injuries suffered by him and the police for denying his constitutional rights.
As a deputy public prosecutor, what I can do for a charge and argument against his case.
