Assignment task: Prepare for the 'meeting' by having a copy of the following documents with you:

Your completed Building Contract (prepared in the previous assessment) ready for client sign-off.

You should be familiar with the project from studying the plans, specifications and other documents.

1. Introduce yourself and the company you work for.

2. Given that the client has recently suggested changing from a Lump Sum to a Cost-Plus Contract, explain these different contract types to the client and make sure the client understands their terms. Also explain the terms cost plus percentage and cost plus fixed fee.

3. Negotiate with the client as to which contract will be used (since you have already prepared this contract, a Lump Sum Contract, you may prefer to go ahead with it).

4. Explain to the client the need for them to be aware that entering into this agreement means signing a legal document that is enforceable by law, and that each party must have the capacity to do so.

5. Direct the conversation to confirming with as much certainty as you can, that the client has the capacity to enter into this agreement and that he/she understands the legality of the agreement.

6. Answer any questions asked by the client.

7. Ensure all of your interactions with the client are with consideration of their cultural background (hence possible unfamiliarity with Australian laws and customs).
