Scenario: The Garbage Collector Run
The City of Albany has 45 garbage collectors. Each of these employees is assigned a particular route. These routes normally take the better part of the 8 hour day. Traditionally, an employee who finishes his assigned route is allowed to go home early.
There is no mention of this practice in the contract. In fact, the contract requires the employees to work an 8 hour day (from 7:30 am to 4:00 pm) with a half-hour unpaid lunch.
Last week, for some reason, the western part of the city had a particulary heavy load of garbage to be picked up. The garbage collectors are in constant telephone contact with the central office as to the progress of their individual run. At 2:00 pm it was obvious that the five drivers assigned to the western part of their city would not finish the necessary collections within the normal workday.
Accordingly, the dispatcher told John Smith and Frank Allen, both of whom returned from their own runs at 2:05 pm, to drive to the western part of the city to help the garbage collectors in that sector.
John Smith informed the dispatcher that he busted his hump the entire day to get done early and he was not going out again. Besides, he argued, he ahd an appointment at 3:00 pm that he had to get to. He quickly punched out and left.
Frank Allen drove to the western part of the city as directed.
When pay day arrived, John Smith found he was docked two hours pay for leaving early. John informed his union and the union grieved, seeking to get John reimbursed for the two hours pay.
