On March 5, Drake drafts a check for $2000 drawn on the Big Bank (BB) and payable to his assistant, Cory. Drake puts last year's date on the check by mistake. On March 7, before Cory had a chance to go to the bank, Drake is killed in an automobile accident. The BB is aware of Drake's death. On March 10, Cory presents the check to the bank, and the bank honors the check by payment to Cory. Later, Drake's widow, Erica, claims that the bank wrongfully paid Cory, because it knew of Drake's death and also because the check was by date over one year old. Erica, as executor of Drake's estate and sole heir by his will, demands that BB recredit Drake's estate for the check paid to Cory. Discuss full BB's liability in light of Erica's demand.
