Moore walked outside her house and encountered Smith, a paint contractor. Smith told Moore that he was there to paint Moore's house. Moore had not requested Smith's services. However, Moore did nothing to prevent Smith from completing the job. After the job was finished, Moore told Smith that he had painted the wrong house. In fact, Smith should have gone three houses further down the street to the home of another individual named Moore. Smith brought suit against Moore. Can he obtain a judgment against Moore?
