Just what to have a 3-5 sentences summarising the legal position of the above topic, as the defined family members, in NSW, are not required to be "witness, at the scene".
For close friends to claim, they must meet the requirement aforesaid in Civil Liability Act 2002 (NSW) s 30(2).
So far as I know, witnessing via TV is excluded in UK (Alcock v chief constable of south yorkshire police), but there is no direct authority in Australia, so my question is, whether it is possible for High Court of Australia to interpret "at the scene" more broadly to include via "aided senses" such as TV or more popular these days streaming via internet?
