Take a look at the case on page 141, Barker v. Wingo. Here there was a 5-year delay in bringing the defendant to trial. The Supreme Court ruled that there was no prejudice to the defendant even though the delay was five years. Do you agree with this ruling? Do you think that you would suffer no prejudice if the Government took five years to try your case? Is there a danger that prosecutors might illegitimately seek continuances?
