Is it possible that society is quick to excuse psychopathy

Question: Is it possible that society is too quick to excuse psychopathy in our courts? For instance, if someone commits an extreme crime that harms another, is the court system too quick to institutionalize them rather than incarcerate them? What is your thought? Also, are we potentially acting upon an act rather than true psychopathy? In other words, do you think some people convince the psychiatrists that they're crazy when in fact they are not?
