Problem
Suppose your client, an asylum seeker, has been convicted of extortion in the U.S. and sentenced to 3 years in prison. Nonetheless she has strong proof that she would likely be persecuted if return to her country. She acknowledged that her erratic behavior was a result of substance abuse, and she entered a rehabilitation program. She has now been sober for 2 years and her psychiatric will testify that a relapse is extremely unlikely. Is she eligible for asylum or withholding? She is in the US.
