Nine days later, Foster committed suicide. Subsequently, a federal grand jury, at the request of Independent Counsel Kenneth Starr, issued subpoenas for the notes as part of an investigation of President Clinton and his staff. Hamilton sought to quash the subpoena, arguing that the notes were protected by the attorney–client privilege. Starr’s contention was that the attorney–client privilege does not apply after the client has died, particularly if the information is relevant to a criminal proceeding. Did Starr get the notes?
