Under current law, newly arrested inmates are allowed to make phone calls. This is often done from the intake/booking area. In this particular jail, inmates can make as many collect calls as they want, provided they don't interfere with operations.

On this particular day, mealtime came for the inmates. The deputy was alone in intake because the assistant deputies had gone to perform other duties. The facility had the minimum staff.

The normal procedure for feeding the inmates was to have them go into a large holding area, form a line, exit to receive a sandwich and drink, and then return to the holding area to eat. The inmate worker, or the trustee, wheeled the food cart into place as the deputy advised all inmates using phones that they needed to finish their calls because it was time to eat. All of the inmates complied except one. The deputy gave several warnings before remotely turning off the phones.

When his call abruptly ended, the inmate slammed down the receiver and yelled at the deputy. The deputy ordered the inmate to go to a holding cell. Rather than comply, the inmate took a combative stance and a fight began.

As the deputy and inmate wrestled and exchanged punches, the deputy noticed that the other inmates were coming back out of the large holding area. These inmates began yelling in support of the inmate that the deputy was fighting. Unfortunately, the deputy had left the radio at the deputy station and couldn't call for help.

Unknown to the deputy, the trustee had quietly walked up the hall and notified the sergeant about the fight. Although the trustee had gone "out of bound," the deputy was glad that he had. Soon, the alarm sounded and help came from everywhere. The inmates were locked in the holding area, and the aggressive inmate was restrained.

The deputy sustained a broken finger and a sprained shoulder. The inmate suffered bruised ribs and a criminal charge.
