Check out the film clip above, which depicts Mark Zuckerberg's deposition. During this deposition, the lawyer for the Winklevoss twins suggests that Zuckerberg was "leading them on for six weeks" by pretending to work on their Harvard Connection website, when, in reality, Zuckerberg was really working on his own Facebook website all along. So, even if the informal agreement between Zuckerberg and the Winklevoss twins was not a legally-binding contract, did Zuckerberg commit the tort of fraudulent misrepresentation by pretending to work on the Harvard Connection website?
