These laws are normally made for people's welfare. They help in ensuring harmony and ensuring there is no conflicts in the society. They are primary made to help maintain order and harmony in a society. The rule of law is made by the government. It ensures that everyone is treated equally, be it rich or poor. With the rule of law, no one is above it. It also implies that the authority of the government is only exercised according to it with the relevant procedures followed. Rule of law does not give anything concerning how the laws are made, it just gives two main concepts; the law must be obeyed by everyone and that those laws should made in a way that help guide the behaviors of the subjects.
The republic normally refers to the rule of law as the rule of will. This is because; laws are made in such a way that man can willingly obey and serve to bring all them into contempt. Referring to the rule of law as the rule of will is a sign of the respect held by the republic towards it. For any nation, it is impossible to make and maintain rule of law if citizens do not have respect for it. Like for example, if a community decide to ignore the traffic laws, signals and signs. This will overwhelm the police officer in charge for the law to be enforced (Przeworski, A, et al, 2003). The enforcement can even bring about dangerous and chaotic activities. Citizens therefore have to willingly follow the law without being forced by anyone. The republic agrees with that fact that it's their responsibility to obey the laws for their own benefits. Those laws are normally things the citizens can easily follow without feeling strained. For any free society, the law must be administered through independent judiciary that is normally trusted by the republicans. The republic that define rule of law as rule of will shows that they trust their independence of its judicial system. They believe that is not in any case under political pressures, private interest and popular opinion in making it is decision. The republic is always confident that everyone will have a fair chance when it comes to presenting their case in court. They do not have any form of doubts.
Even though the Rule of law in made mainly to ensure justice is served to republic in the judicial systems that is not always a guarantee of justice. The cases are more often carried out by inexperienced judges. This greatly affects the justice served to the people. Corruption is another major factor that inhibits justice in the judicial. The judges are always aware of what should be done but still goes ahead and accept bribes to give false judgment before the court. This hinders the republic against getting justice even though they have the rule of right. However much the republic may know their rights and the rule of law protecting them, it is quite impossible for a common citizen to have the enough legal evidence to accuse any judge. That is why corruption continues to grow at the expense of the criminal justice. The judges know they are protected and most of them take advantage of that. Even is a republic manages to gather enough evidence against a corrupt judicial body, there are no rule of law or working mechanism that can help them in impeaching any member of the higher judiciary. For the criminal justice to be served, our judicial systems have to be purified to do away with the corruption contaminations. Also, for the rule of law to maintain its significance in the society, corruption must be eliminated completely. Even though it seems impossible because we live in a country where 50% of the judicial system is corrupt, corruption must just be dealt with by all means.
