There is a growing concern among the board members regarding risks on how to engage with transgender students, faculty, and staff members. After much prayer and discussion, we plan to propose a policy in which our institution will recognize and acknowledge a person's biological gender. I understand that you may have thoughts and opinions regarding this decision, but we will save that for another time. The purpose of this note is to inquire about the legal risk of this type of policy. Because we are a private and faith-based institution, what risks do we have in developing and implementing a policy of this nature?
