Problem:

You have just been hired as the Vice President of Human Resources Compliance for the Boobies chain of restaurants. Boobies is a vaguely nautical themed restaurant/sports bar that sells primarily wings, bar food, and BBQ with beer and cocktails. The Boobies icon is a blue-footed booby bird, famous for its mating dance. The Boobies servers (Sirens) wear sexy pirate-esque outfits: pirate scarves on their heads, sexy knee-high pirate boots, short black and white skirts, and tight white T-shirts with the Boobies bird, who wears an eye patch. Between service they perform some sea shanty dances on the bar, Coyote Ugly style. Boobies has a policy of hiring only young, curvy, female servers. They claim that the Boobies Sirens are at the essence of the experience. People of any gender can be Boobies Mateys, i.e. busboys, managers, bartenders, cooks, hosts and hostesses, but the servers are all female.

Corporate Counsel fears the policy will lead to litigation. Management is adamant that the Sirens are an essential part of Boobies and that the business model cannot survive without them. How do you handle the policy? Do you make changes?
