John's Pizzeria has an opening for a manager position. Two internal candidates apply for the position, one candidate is a single female and the other candidate is a male who is married and has 2 children. The hiring manager feels both candidates are qualified and is torn between who to give it to. The hiring manager determines that the male most needs the extra money because he has a family to support and gives the job to the male. He later tells the female candidate there reason for the decision and she sues claiming gender discrimination. Will the female employee win the lawsuit? Why or why not?
