General Car Motors Ltd, trading as Praad Australia, published newspaper and magazine advertisements between 29 January and 13 March last year promoting its entire range of Praad motor vehicles as green friendly. The advertisements contained the words and statements “GRRRREEEN” and “Every Praad is green. Carbon emissions are neutral across the entire Praad range” and “Save the planet”. In the same advertisements General Car Motors Ltd stated that in the first year of a Praad’s purchase, General Car Motors Ltd would plant 17 native trees that would offset the carbon-dioxide emissions of a Praad vehicle for its life.
The reality, however, was that the planting of 17 trees would only offset the car’s carbon-dioxide emissions for one year.
Specifically explain whether or not an action would be available under section 18 of the Australian Consumer Law.
