Forensics and forensic evidence one of the issues

Part 1

In this module, students were exposed to some of the main criminal justice responses to cybercrime. Specifically, forensics and forensic evidence. One of the issues surrounding forensics and forensic evidence is that it requires a high-degree of knowledge and expertise from law enforcement to process. As such, law enforcement agencies and individual officers must be highly trained on the technical issues that are attached to this form of evidence collection. However, a broader philosophical question remains on balancing protected ‘free speech' and civil rights with safety and security. This issue has recently been brought up with Edward Snowden's revelation of government information collection efforts and Apple's refusal to grant the FBI access to the terrorist's iPhone in the San Bernardino, CA shooting in December 2016.
For this discussion post, I want each of you to do the following: 1) Read the provided articles (a) Apple's Customer Letter Regarding San Bernardino Fight and (b) The Guardian's Nellie Bowles' argument for why she believes that Apple should help the terrorists; 2) Choose a side of whether you believe that Apple should either help or not help; 3) Choose a minimum of three reasons why you believe what you do; and 4) Provide two-to-three sentences per point to explain your position. You are more than welcome to seek outside resources for citations to support your claims.

Part 2

In this module, students were exposed to some of the overall conceptual issues that face criminal justice practitioners at attempts to prosecute and sentence cybercriminals. In Modules 5 and 13, I asked you to read Wired Magazine's story on the silk road. If you have not yet done so, this discussion post requires you to have read both parts one and two of Wired's story The Untold Story of Silk Road. I have included them in this module for convenience purposes. As you are reading the story, I want you to do the following: 1) Select and discuss two examples cited in the story of an issue(s) with collecting, analyzing, and/or presenting digital evidence; and 2) provide discussion of your chosen example matches one of the four principles of jurisdiction (i.e., territoriality, nationality, protective, and universality).

Part 3

In this module, we discussed issues related to the future of cybercrime and its role in the criminal justice system. Moreover, we discussed the four primary issues that need to be considered when approaching cybercrime legislation. For this discussion post, I want you to do the following: 1) Pick one piece of U.S. legislation (either at the state or federal level); 2) provide a two-to-three sentence overview of the chosen legislation, 3) and offer a minimum of three ways that this piece of legislation can be improved to better address cybercrime issues. I would suggest using your textbook to find some options of the legislation that you may want to evaluate.
