Question:

Rachel and Kelly have applied for the ROI clerks position at VBMC. Both Rachel and Kelly are recent HIT, associate degree, graduates. Rachel recently achieved her RHIT credential and has 5 years of HIT experience. Kelly has also achieved her RHIT credential but has no experience. Rachel and Kelly both have been interviewed with the HIM director virtually. The HIM director is torn as both had a great interview and references. The HIM director asked them both to come in to meet in person and sign documents for drug screening and background checks. They both went in to complete the necessary paperwork and the HIM director noticed Rachel was in a wheelchair. They both completed documents and were informed they would be contacted. Background and drug screenings were clear for both. Rachel was informed they unfortunately will not be hiring her. The HIM director offered the position to Kelly. In your opinion, does this violate the Amercians with Disabilities Act? Identify the best plan of action.
